The legal status of Hemp or CBD oil in the UK

To understand CBD regulation in the UK we need to take a closer look at the origins of the restrictions of the plant itself. Nowadays no one would question the usefulness or the effectiveness of this super-plant but this was not always the case. So let’s take a look at the more relevant laws passed in the UK regarding the cannabis plant.

A brief history of UK cannabis legislation enacted over the years

  • 1928 The Dangerous Drugs Act was passed and the first laws on the possession of cannabis were introduced to Britain.
  • 1967 saw The Dangerous Drugs Act (prevention of misuse) in which recommendations were made to reduce the penalties for possession of cannabis.
  • 1971 The Misuse Of Drugs Act, has a restriction is placed on the cultivation of all species of the cannabis plant.
  • 2001 and the Misuse of Drugs Act (regulations) New laws permitting cannabis cultivation under a special licence issued by the Home Office and the smoking of cannabis for research purposes are passed.
  • 2015 The Misuse of Drugs Act (Designation) The first cannabis-based medicine in the UK  is allowed on to the UK market under prescription.

CBD is Legal – THC is not

As we know cannabis products containing THC are still illegal. A slow and long overdue relaxing of the restrictions of its use has seen a rise in popularity of hemp and CBD oils. Although the law is fairly clear there are still grey areas and some of the more frequently asked questions include:

Is CBD oil legal in the UK?

Yes. CBD oil is totally legal in the UK it is extracted from a cannabis plant that is grown separately and cultivated differently from those grown for drug use.

Can I drive after taking CBD?

Yes. There are no psychoactive ingredients in CBD and you will not fail a roadside drug test. It is wise to not to take CBD for the first time and then jump in your car. Even though there are no psychoactive components in our CBD oil there could be minor side effects which you should be aware of before you drive. CBD does not affect your driving skills but you could get an upset stomach which could distract you.

Will I fail a drug test if I take CBD?

It is very unlikely even if you are a professional athlete. CBD only appears on drug tests which test for cannabinoids, rather than THC. These are unusual drug tests and only applied in certain circumstances. Up until recently for example, a professional athlete would fail a drug test as their doping tests were for cannabinoids and not specifically THC or CBD. They recently changed this regulation to allow CBD for professional athletes. For those taking a work based drug test, or a roadside test by police, you will not fail or even register on those tests, because they test for THC which is illegal in the UK and not CBD which is legal.

Is it OK to operate heavy machinery after taking CBD?

Some people may experience slight nausea and/or a relaxed feeling the first few times they take CBD. As in all matters of safety it is best to err on the side of caution and steer clear of operating heavy machinery if they feel affected by it. As CBD is not psychoactive, any relaxant effects are minimal and are mental rather than physical in nature.

Can anyone use CBD oil?

Yes, it’s always wise to consult your GP before taking any dietary supplements but this is a 100% natural product and should suit pretty much everyone, from children to the elderly!

Can I fly with CBD oil?

From a legal standpoint, you are quite entitled to take CBD with you on your travels within Europe. Before taking CBD to countries outside the EU, it would be prudent to check the legal status of CBD in the destination country.
